These Terms of Service ("Terms") govern your access to and use of the Kthulhu platform ("Service"), operated by Kthulhu ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Service Description

Kthulhu provides an autonomous AI-driven smart contract security analysis platform. Our multi-phase pipeline — triage, multi-model ensemble analysis, and formal verification — analyses submitted contract code and produces structured audit reports. The Service is provided on a credit basis.

2. Account Registration

To use the Service you must:

Provide accurate organisation and contact information
Create a secure password and keep it confidential
Accept responsibility for all activity under your account
Notify us immediately of any unauthorised access at legal@kthulhu.co

You may not share accounts or credentials between organisations. Each organisation must maintain a separate account.

3. API Keys and Access Credentials

API keys (kth_…) are displayed once at account creation and cannot be recovered. You are responsible for:

Storing API keys securely (use environment variables — never commit to version control)
Revoking compromised keys immediately via the dashboard
All API usage under keys issued to your organisation

4. Acceptable Use

You agree not to:

Submit malicious code, exploits, or content designed to harm our systems
Attempt to reverse-engineer, scrape, or extract our AI models or proprietary methods
Resell or white-label the Service without written authorisation
Use the Service to audit contracts you do not own or have authorisation to analyse
Circumvent rate limits, quotas, or access controls
Submit personally identifiable information of third parties without consent

5. Audit Results — Disclaimer

Kthulhu audit reports are produced by AI agents and represent automated static analysis findings. They are provided for informational and educational purposes only.

Results are not a guarantee of security
Results do not constitute a professional security certification
Results do not constitute legal or financial advice
A "clean" audit does not guarantee the absence of vulnerabilities

Human expert review by qualified blockchain security professionals is strongly recommended before deploying any contract to a production network.

6. Intellectual Property

You retain ownership of all smart contract code you submit. By submitting code, you grant us a limited, non-exclusive licence to process it solely for the purpose of producing your audit report. We do not use submitted code to train AI models.

Kthulhu's platform, branding, agent architecture, and audit report formats are our intellectual property and may not be reproduced without permission.

7. Payments and Credits

Audit credits are non-refundable once an audit job has been queued
Subscription fees are charged in advance and non-refundable for the current period
We reserve the right to modify pricing with 30 days' written notice
Failed payments may result in account suspension

8. Limitation of Liability

To the maximum extent permitted by applicable law, Kthulhu shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to: financial losses from smart contract exploits, missed vulnerabilities, business interruption, or data loss.

Our aggregate liability to you for any claim arising from these Terms shall not exceed the amounts you paid to us in the 90 days preceding the claim.

9. Termination

You may delete your account at any time by contacting us at legal@kthulhu.co. We may suspend or terminate your account for breach of these Terms, non-payment, or illegal activity, with or without notice at our discretion.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.

11. Changes to Terms

We may update these Terms at any time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service constitutes acceptance of the updated Terms.
